Cro-Mags - Harley Flanagan Sues Band Over Name

According to the New York Post, former Cro-Mags frontman Harley Flanagan is now suing the band in a Manhattan federal court, claiming they have illegally usurped the group. Harley Flanagan says the punk band Cro-Mags was his idea when he formed it back in 1981.

But around 2002, other members, including singer John Joseph McGowen, took over the band and used the Cro-Mags name without his permission, Flanagan says in the suit. After that, the band went on without him and is now in the midst of a world tour that heads to the UK, Germany and France in June.

Flanagan is suing in part for copyright infringement, saying he trademarked the "Cro-Mag" name for recording in 2010 and for merchandise in 2009 and then again in 2017.

There is bad blood between Flanagan and the band as the singer/bassist showed up at the group's 2012 performance at New York's Webster Hall where he allegedly attacked two people, including one band member, with a hunting knife, causing the group to cancel the show. Assault and weapons charges against Flanagan were later dismissed.

About time. This band has been hijacked by John Joseph and his mediocre crew for way too long. Mayhew and Harley haven't been getting any royalties from the merch and albums sold by the band ever since Joseph got his greedy muscular hands on it. The music was written by Mayhem (first 2 albums and Revenge) and Harley (all of them), so they are entitled to own the name. And they founded it, John joined later on and was in and out.

Having played shows across North America with the likes of Power Trip, Iron Reagan, Municipal Waste, Exodus, Obituary, Terror and also a European tour with Foreseen last year, RED DEATH are currently working on the final touches of new material for their upcoming third album and Century Media Records debut. The album will be recorded with producer Arthur Rizk (Code Orange, Power Trip, etc) and is expected to be released later in 2019.
United by a love for "Master Of Puppets"-era Metallica, "Animosity"-era Corrosion of Conformity, Discharge and the best of 80's Thrash Metal, RED DEATH was born out of a 2013 basement jam session between drummer Connor Donegan (also of Genocide Pact), guitarist Ace Mendoza and frontman Chad Troncale. RED DEATH became an underground favorite with the release of 2015's "Permanent Exile" followed by US gigs and tours with the likes of Power Trip and Obituary. With 2017's "Formidable Darkness" album and a line-up that saw Troncale assume bass and vocal duties as well as the addition of Enforced guitarist Will Wagstaff, RED DEATH proved themselves a force to be reckoned with as they blasted stages around the world. 2019 promises the band's third full-length as they take up serious contender status with new label Century Media Records.

Press quotes about RED DEATH and their previous release "Formidable Darkness":

They can appeal to any end of the extreme music world spectrum, especially on this record. No matter what the lineup is, RED DEATH fits, a feat rarely and not so easily achieved. - No Echo

RED DEATH, and "Formidable Darkness" specifically, bring out the best elements of hardcore and thrash. There are no filler parts, only mean transitions that draw on both old and new clichés to get people moving. - CVLT NATION

Washington, D.C.'s RED DEATH, much like Power Trip, practice the crossover approach as we meant it in 1987, playing ripping thrash with mosh pit-ready breakdowns. - Revolver (online)

CRO-MAGS members John Joseph and Mackie Jayson have reached an agreement with their former bandmate Harley Flanagan over the rights to the group's name. Going forward, Joseph and Jayson will perform as CRO-MAGS JM while Flanagan will get to use the CRO-MAGS name for his own version of the band. ? Blabbermouth.net
