Apocalyptica - Issue Statement Regarding Rammstein Lawsuit

Following the recent commotion concerning a lawsuit for copyright infringement filed by Rammstein, Apocalyptica have now released a statement clarifying the events:

"The article's headline [at Anwalt24.de, ed.] is substantially wrong: neither the band Apocalyptica nor their management are or were involved in the described lawsuit. However, the parties involved are the band Rammstein and Sony Music Entertainment GmbH, as the successor of the by now defunct affiliated label "Gun Records".

Apocalyptica and Halbe Miete Management regret the events, but neither had any influence on a violation of trademark and naming rights, nor any part in whatsoever resulting agreements.

It is correct, that "Gun Records" published advertisements with the stated endorsement disregarding existing agreements, and the band Rammstein subsequently filed a lawsuit against Sony Music Entertainment GmbH as the parent company. It is furthermore correct, that Sony Music Entertainment GmbH and Rammstein have agreed on a settlement. The details of which, however, are unknown to Apocalyptica and Halbe Miete Management. We ask that further articles on the topic correctly reproduce the facts."

Also last week, Apocalyptica was involved in another incident where they were forced to pull the vocals of Shinedown frontman Brent Smith off the new single, Not Strong Enough. The band apparently failed to secure the rights from Shinedown's label, Atlantic Records, to release the song to radio with Smith's vocals on it. An official statement regarding this incident has yet to be made.

Rammstein - Win Lawsuit Against Apocalyptica

The Regional Court of Berlin has convicted Apocalyptica for trademark infringement against Rammstein. The Finnish cello metallers face a fine of ?45,000.

The case concerns the advertising campaign launched in Germany for Apocalyptica's 2007 release Worlds Collide. Worlds Collide featured many guest musicians, including Rammstein frontman Till Lindemann and guitarist Richard Z. Kruspe on the track "Helden" (a David Bowie cover of "Heroes"). The band promoted the album's release on stickers, magazines and posters with the words "featuring Rammstein", this without the authorization of the band and their management.

UPDATED, in case you have trouble understanding: Apocalyptica used the name "Rammstein", which is a trademark, for commercial use without authorization of the trademark holder. The trademark holder (Rammstein and their management) rightfully filed a lawsuit against Apocalyptica for copyright infringement. They won.

Rammstein - New Video Online

"Haifisch" (Eng: "Shark") is the third single from the Rammstein album Liebe Ist Für Alle Da.

According to a press release: "We learn from it that the shark not only has teeth - he's got tears as well. But since it lives in the briny deep, no one sees them. A shame. After all, this cartilaginous fish is one of the oldest of the world's many misunderstood creatures. A bit more sympathy couldn't hurt!"

For the video to "Haifisch", Rammstein worked once again with Jörn Heitmann. To watch the clip at this location.

Rammstein - Bustle In Belarus, Cont'd

Original news, posted on 24.02.2010

Rammstein are in trouble... again. Authorities in Belarus have declared Germany's Rammstein a threat to the state. They questioned an upcoming concert in Minsk, saying letting it go on would be a "costly mistake" for the country.

Rammstein's music could "destroy the Belarusian state system," said the country's Public Council on Morality on Monday. The Council described the band's songs as propaganda for "violence, masochism, homosexuality and other abnormalities" and said "permitting a Rammstein concert would be a costly mistake."

The German group, which is known for the sexual and violent nature of its lyrics, was scheduled to perform at Minsk Arena on March 7. Writer Mikalay Charhinets, head of the government's Public Council on Morality said he regretted that tickets had already been sold for the concert, but that if the event were to take place, the program would need to be revised in order to prevent "extremism."

Belarus is a former Soviet republic and has been ruled since 1994 by President Alexander Lukashenko, who has been referred to as Europe's "last dictator." The country's Public Council on Morality, a state-sponsored censorship agency, was founded in 2009 and has been accused of suppressing freedom of opinion.

The Rammstein concert organizers told the Interfax-West news agency on Monday that they had "no information that Rammstein will spread violent, perverse, cruel or Nazi ideology at their concert in Minsk."

UPDATE

In an ongoing quest of the Belarusian Public Council on Morality to make complete fools of themselves, the members of the Council now demand a preview of the show that Rammstein are scheduled to perform in Minsk on March 7. Here's the story as reported by Naviny.by - a Belarusian news site:

"The members of the Council believe that with its work, the band openly propagates homosexuality, masochism and other perversions, as well as cruelty, violence and abusive language," the Public Council on Morality said in a statement issued on Monday. "The group's concerts often feature live acts of intercourse, ejaculation and acts of imitating the Nazis."

"We looked through pictures and watched videos of Rammstein shows," Mikalay Charhinets, chairman of the Council who heads the government-backed Union of Writers of Belarus, said in an interview with BelaPAN. "They really show pornographic, violent and cruel scenes," he said.

Rammstein - More Censorship Issues

After being censored for the pseudo mini-porn video that was "Pussy" and the controversies surrounding the single "Ich Tu Dir Weh" (I Hurt You) and a picture inside the album booklet displaying guitarist Richard Z. Kruspe spanking a chubby woman wearing only a mask, it seems that also two Rammstein live shows will be censored now.

In November the album Liebe Ist Für Alle Da got "indexed" by the German Federal Department for Media Harmful to Young Persons, making it illegal in Germany for minors to purchase the album, or display it where it can be seen by people underage, effectively banning it from stores. At the time, keyboardist Christian Lorenz expressed surprise at the advisory board's "parochial sense of art" and regretted their apparent inability to detect irony.

Now, the German Family Ministry authorities will not allow the band to perform any songs that have been indexed on both their Dortmund shows. Furthermore, the ministry demands each band member to sign a "written explanation before the concerts, that the indexed songs will indeed not be played." In case of violation, the band faces a fine of ?10,000, per person. Public Order director Ortwin Schafer also stated that the Youth Protection Act will be put into force in conjunction with the police and "fans under 18 must be accompanied by parent or guardian of a person to attend the concert. Fans without a parent or guardian in attendance will be sent home."

Both concerts, each with over 10,000 attendees, are both sold out. Though the organizers tried to downplay the situation: "We have received no request of the public order of Dortmund", says Silvia Pape of "Concert Team NRW". However, there were already telephone contacts. Pape: "Once we have something on paper, we will forward it on to the management and the band. The final decision lies with the guys. "

Rammstein - New Album On The Way

Original news, posted on 07.11.2008

Rammstein have announced the following:

"Now that the band has finished pre-production in Berlin for its new album, Operation "Album 6" is going forward full steam ahead. Christoph Schneider arrived in Los Angeles last week to meet with Jacob Hellner and production team (i.e., currently Ulf Kruckenberg and Florian Ammon) to undertake preparations for recording of all the drum tracks. Also to arrive in L.A. this week for the drum sessions, Paul and Richard. Finally, a studio has been rented near San Francisco for the bulk of the main recording work, and the band will go into retreat there for several weeks starting on November 9th, 2008. Clear the decks, the Rammstein tanker is once again under steam!"

UPDATE

Rammstein have issued the following minor update via their newsletter:

"While Rammstein are recording their newest studio album in sunny California, the first snow has fallen today in Berlin. You have sent us a lot of questions since news reached you via the Rammstein website about the recordings for the new album. Many rumours have flooded the internet since then. The production of the album will take some time and a release isn't planned before autumn 2009. If everything goes according to plan, we'll hear the first single before summer 2009 and be able to greet Rammstein at the beginning of their tour before the end of the year. This tour, which is to stretch far into the year 2010, will finally give you enough of a chance to see the band live again after the long period of waiting. Above all, there are some surprises in store for our loyal fans and Community members in the 2009/2010 tour year."

Rammstein - Beware Of Hoax!

The following statement has been cited on blabbermouth:

German industrial metallers Rammstein have parted company with singer Till Lindemann.

According to an official statement from the band, Lindemann's decision to leave the Grammy nominated outfit was because of "inharmoniousness within the band" and was "well deliberated."

"He will head now for other challenges which can be a solo career or maybe a new project," continues the statement.

The band have announced that former KMFDM man En Esch will take his place on vocal duties. Rammstein guitarist Richard Kruspe and drummer Christoph Schneider added:

"Nobody ever can replace Till Lindemann but since we have still so much fun doing Rammstein we looked for a new singer which is charismatic in his own way without copying Till.

"We all will miss Till Lindemann who gave us many years of joy by listening to his unique grinding voice. Please welcome the talented En Esch - Till's footsteps are big, but maybe he can dry our tears rapidly.

This news took the metal world by storm; however, it has not yet been confirmed by any official source. At the moment, allsigns in the sky point to all of this being an elaborate hoax.

Statement by the band (on Rammstein website) on July 19:

Since the rumour did alarm people that Till Lindemann would leave Rammstein after the release of the upcoming album, we are pleased to inform you that after consulting Rammstein manager Emanuel Fialik, the so-called news turns out being a fake.

"Neither Till Lindemann nor another band member plans to leave Rammstein. The band is currently working on the next album and is in an excellent mood. As the greed for news is the actual doping in cycling, this 'news' is only serving those who spread the same. Though the world knows now that EnEsch has moved to Berlin, even the poor EnEsch was shocked by the outlook to have to step into Till Lindemanns footsteps. I hope he and the fans of the band will recover soon from this false report."
