Immortal - Abbath Responds, Working On New Album With Other Musicians


The drama continues on Immortal's camp. There have been new updates on their Legal Battles In The North over the band's name/logo. The group's frontman Abbath (Olve Eikemo) has attempted to claim rights to the Immortal name via his sole proprietorship Eikemo Compositions. Guitarist Demonaz (Harald Nævdal) and drummer Horgh (Reidar Horghagen) want the Immortal trademark to be shared by all three members. Well, Abbath has responded and says he attempted to secure exclusive rights to the band's name and logo because he thought drummer Horgh and guitarist Demonaz had quit the band, according to Dagbladet.no. More things have come up, as the fact that Abbath has been working on a new Immortal album with other musicians.

In his latest letter to the Norwegian Industrial Property Office, Abbath says that he thought Demonaz and Horgh left Immortal earlier this year after they moved out of the band's rehearsal room and stopped paying their share of the rent expenses. Why not have a conversation?

Abbath (Olve Eikemo) wrote in his letter to the Norwegian Industrial Property Office: "This summer Olve received a message from Harald [Demonaz] and Reidar [Horgh] indicating that they wanted to take a longer break from Immortal after a conflict occurred between Olve and the other two bandmembers."

"The band rents a rehearsal space where costs were being shared between the three bandmembers. Harald and Reidar did not want to pay their share of the rent since the band, in their opinion, was not active. Olve, as songwriter, was dependent on the rehearsal [space] and was willing to cover the rental costs himself. The other two members then moved out of the premises and stopped paying their share of the rent. Olve perceived this move as them pulling out of the band."

The letter also argues that Demonaz has not played guitar since he suffered an injury to his arm in 1997, and that Horgh's role in the band has been limited to playing drums. In addition, Abbath claims that, as Immortal's composer and frontman, he is virtually synonymous with the band and that, as a professional musician, he is dependent on revenue generated by Immortal and therefore cannot simply take a break.

The letter also reveals that Immortal is contracted to deliver a new album to the German label Nuclear Blast and that Abbath has now almost completed work on the album with the help of other musicians.

"[Nævdal and Horghagen's objection to Eikemo's application] appears to be an attempt to prevent Olve from engaging in his profession. He has spent 25 years trying to incorporate his character Abbath and his music under the trademark Immortal. It seems unreasonable that the band's ex-members can prevent him from registering the trademark Immortal, especially since they are not qualified and presumably have no desire to take part in any band activities in the future."

Meanwhile, Demonaz (Nævdal) told Dagbladet that he has seen Abbath's letter and so has his lawyer. He also says that they will respond as the letter contains incorrect information.

So, it seems that this might go on for a while.

Yes, exactly. At least if music is percieved as an artistical expression, the artist should have every freedom he needs to create something that is as honest and authentic as possible.
This freedom is not given if the artist depends on the money he gets from selling his art, because he will aim to create something that just sells well.
There is even less freedom if a company forces the artist to create something that sells well, and does not allow any form of experimentation.
This might not fit the Immortal case exactly, but it fits the whole music business in general. The number of labels that value the aforementioned freedom decreases steadily.
Why else would there be so much crowdfunding lately?

the company is not forcing an artist to do that, the artist chose to sign a contract with those conditions
it is the artist using their freedom to choose accepting that deal

there is crowdfunding because other artists choose differently

I'm with Abbath if what he claims is the truth, though with Demonaz and Horgh claiming he's not telling it right, who can know?

More importantly I'm just sad, I still haven't seen Immortal live since I missed my opportunity to go to Bloodstock 2011. Looks like I'm gonna be waiting a few more years now...

No art is worthless, I believe that art should be created for oneself, as a profound and emotional expression,
whithout the intention to be released to the general public (thus it is debatable if Immortal's music is art).
And how much of a free choice is signing a contract when there are no real alternatives?
I don't blame Immortal for making poor decisions, it's just the music business as a whole that is a bit fucked up,
amd it's actually getting better since the chances for independent artists are increasing due to internet and crowdfunding

For those who have never been a professional musician let me make this as simple as I can. That is how you make a living and YES you depend on the revenue hence the PROFESSIONAL title. I have sold my art (music,tattoos,voice acting) to those wanting for nearly 30 years now. That's how I live and i depend on the revenue same as Abbath. I understand where he is coming from 110%. If the other guys don't have any interest being in Immortal then hit the road and stop this shit so contractual obligations that they ALSO have to make the record can be completed and the band can continue. Its a business folks and if it were you I guarantee you wouldn't be doing it just for the art alone.
