Idle Hands - Forced To Change Band Name

Not some 'everyday news' is coming from the gothic metal outfit Idle Hands. Due to US trademark law, they are no longer able to perform or record music under the current band name, and they are consequently forced to change it.

The band states: "Due to US trademark law, we are no longer able to perform or record music under the name Idle Hands. We have done everything in our power to retain the name but we can not. While regrettable, these things happen. Subsequently, we are liquidating almost all Idle Hands merchandise at extremely reduced prices until sold out at this location."

So $18.50 shipped for an import, not horrible if you think of it that way. But yea, seems they may be recouping some lost money on shipping. Worth it in my opinion, Mana is an awesome change of pace record.

So what trademark have they copied? Is it another band? I thought a band could call themselves whatever they want if it's not taken. Sometimes there are double ups like Shining (NOR/SWE), does that mean it wasn't trademarked first? So many questions!

I think in USA is more stricter as in Scandinavia or Europe in general , but I would like to know what they did wrong.

Could be the case. Strange though that it would be such an issue in the USA while most other countries don't seem to care.

I mean apart from Shining like Ball Fondlers mentioned there are numerous others (and some of them even in the USA)

- Dark Forest UK/CAN
- Sorcerer SWE/ARG
- Anthrax USA/UK
- Blaze UK/USA
- Cathedral UK/USA

So I would find it strange if that's suddenly an issue for the USA.

I don't think whoever is suing them is necessarily another band.

there are a few bands that have the same name.
There was band named Skid Row in the early 70s, a young Gary Moore was their guitarist.
I always giggle when I see here on MS a band called Colosseum. No trouble with this name? because there was a quite famous prog band called Colosseum. I guess not, or people have better things to do, I dunno...
There was a band in the UK late 60s early 70s named Nirvana.
I bet there are a few bands called Quo Vadis. I know a blues-rock band with this name.

The whole story with Idle Hands having to change their name is weird. So some Americans got upset a metal band from Greece is using this name. How and why?

Exactly. The trademarking could be from a company or business entity of some sort.

Apparently, the US trademark holder is this band: Idle Hands.

(filed 2012, registered in 2014)

"Paul Van Duine" happens to be their guitarist.

There's a brewery in Massachusetts in the USA named Idle Hands but they're pretty small. Doubt it was them, or maybe they're next!
