Guns N' Roses - Leaker Guilty Of Copyright Infringement

E! Online is reporting that, the California man charged with illegally leaking tracks of Guns N' Roses' near-mythical "Chinese Democracy", pleaded not guilty today in federal court.

Kevin Cogill, a 27-year-old blogger known as "Skewrl" who uploaded nine tracks from the forever-in-the-works LP on his Antiquiet in June, was busted Aug. 27.

Cogill was charged under a three-year-old federal anti-piracy law that makes it a felony to distribute a copyrighted work on computer networks before its release. He was released on $10,000 bail.

If convicted of the misdemeanor count, Cogill faces a possible five-year prison sentence and a $250,000 fine. However for a jury to find him guilty, prosecutors must prove beyond a shadow of a doubt that Cogill unlawfully disseminated the previously unreleased songs for profit.

Ex-Guns N' Roses and current Velvet Revolver lead guitarist Slash slammed Cogill in a recent interview, telling the Los Angeles Times, "I hope he rots in jail. It's going to affect the sales of the record, and it's not fair. The Internet is what it is, and you have to deal with it accordingly, but I think if someone goes and steals something, it's theft."

Assistant U.S. attorney Craig Missakian, who pursued the case with the FBI and recording industry, said, "In the past, these may have been viewed as victimless crimes. But in reality, there's significant damage."

Cogill posted the songs at a web sitecalled Antiquiet, where they were available for public access. The site crashed from the amount of traffic it received once word of the leaked tracks got out. Cogill took them down again after he was contacted by representatives of Guns N' Roses.

The tracks were allegedly taken from the band's yet-to-be-released "Chinese Democracy" album. Cogill, who used to work in distribution for the group's record label, says he received them from an anonymous source.

After his arrest, Axl Rose and crew issued a statement saying, "Though we don't support this guy's actions at that level, our interest is in the original source. We can't comment publicly at this time as the investigation is ongoing."

UPDATE

The Los Angeles man accused of uploading nine pre-released Gun N' Roses tracks pleaded guilty Monday to one count of misdemeanor criminal copyright infringement.

Kevin Cogill faces a maximum of one year in federal prison, a $100,000 fine and five years probation when sentenced in Los Angeles federal court on March 3. But he faces no jail time in a deal (.pdf) cut with prosecutors, in which the 28-year-old agreed to cooperate with authorities.

Abaddon Incarnate - New Label, New Album

Irish Death metal/Grindcore act Abaddon Incarnate have issued the following announcements on their MySpace:

"Firstly we are happy to announce we have just signed a 3 album deal with Metal Age Productions from Slovakia joing our friends Desecration and Putrefy along with bands such as Avulsed, Enthrallment, Fleshless, Supreme Pain and Holocausto Cannibal.

We enter Trackmix Studios in Dublin in January to start recording our new album, we are recording 20 tracks and are going to try narrow it down to make sure the album has no fillers or let downs. We do not have a release date yet but once recording and artwork is complete there will be no time wasted.

In other news, Sentinel Records are re-releasing "Dark Crusade" previously released by Spain's Xtreme Music in 2004. The re-release wil contain new artwork and bonus material."

Abaddon Incarnate are also working hard to play more festivals and tours, more news to come on that but for the moment the band will appear at the following:

Whiplash - Sign With Pulverised Records

Reactivated New Jersey metallers Whiplash have inked a worldwide deal with Pulverised Records. The band will enter the studio in early March to begin recording its sixth album, "Unborn Again", with guitarist/vocalist Tony Portaro handling the production duties. Co-producing the effort will be Harris Johns, who has previously worked with Coroner, Helloween, Kreator, Sepultura, Sodom and Voivod, among many others. The band will also document the full recording session and edit the footage into a free bonus DVD.

Commented Portaro: "We are thrilled to be working with Calvin and everyone at Pulverised Records. Their enthusiasm surrounding the "Unborn Again" project is unmatched by any of the labels that we have worked with in the past. It will also be my pleasure to work side by side with the Harris Johns and although the actual recording of "Unborn Again" will not begin until March of 2009, we are eagerly anticipating mixing and mastering with him at Spiderhouse in April."

Added Pulverised label manager Calvin: "We are more than just honored to have the legendary Whiplash step foot into the Pulverised roster, and pre-production works have already commenced for the new album titled "Unborn Again". The band who once gave you such classics like the 1985 maiden album "Power And Pain", the crushing "Ticket To Mayhem" and the innovative 1990 release "Insult To Injury" are back to set the hungry thrash maniacs on rampage!"

Whiplash will release a 25th-anniversary DVD in late 2009 entitled "25 Years Of Thrash". According to the group, the disc will feature "true stories that cover the band's history with Roadrunner Records and beyond, 1985-1990, "Power And Pain", "Ticket To Mayhem", "Insult To Injury"; The Massacre years, 1996-1998, "Cult Of One", "Sit Stand Kneel Prey"; "Thrashback"." It will also include rare concert footage, photos, interviews, backstage footage and much more. "25 Years Of Thrash" will also "take you back in time, hands on the mixing board in very raw setting as the band shares their experiences of the writing and recording of some of the greatest Whiplash albums released to date."

Portaro remained the pillar of the band while the lineup went through many changes over the course of their six full-length CDs, including "Cult Of One" in 1996 and "Sit Stand Kneel Prey" in 1997. During that time, drummer Joe Cangelosi supplied the drumming on "Cause For Conflict" for Germany's premier thrash band Kreator, which was released in 1995. Portaro handled the guitar work for Billy Milano's M.O.D. on a European tour in early 1998 with drummer Tony Scaglione, inviting the return of the original Whiplash lineup for a reunion CD entitled "Thrashback".

Theatre Of Tragedy - Working On New Album, Demo Samples Available

Theatre Of Tragedy have updated their website with the following news:

"Another year has passed and not much has happened publically with the band. Rest assured we haven´t just been lazy (well a bit of that too :-). The year has mainly been spent writing and rehearsing the new material for the upcoming 7th Theatre Of Tragedy album. So far 12 songs are done and 10 of those will make it to the album.
As usual we are nowhere near a title for the album, not even a songtitle is ready, but it will come.

The drums have been recorded together with a really nice guy called Alexander Nyhus and now we are waiting for our producer to finish up his current project with some elderly pop legends. Recordings are planned for February and March so a release date should be either June or August depending on what AFM Records want to do.
Erik Ljunggren will be handling the production side of things. We are very pleased about working with him again. He knows the band very well and is a wizard when it comes to sound. He has turned the knobs for The Kovenant, Kari Rueslåtten, A-Ha, Seigmen, Zeromancer, Satyricon. But for us he will alway be the mastermind of the legendary industrial metal band Vampire State Building. We even played support for VSB in our early beginnings of 1995. Time goes by fast.

As the year reaches an end we want to wish you all a nice christmas, or whatever you celebrate, and a happy new year. Here are two new demo clips for all of you to enjoy over the holidays!"

Autopsy - Releasing New, Albeit Very Limited, Material

Peaceville Records announced today that, for the first time in nearly 15 years, two vile new Autopsy tracks were recorded in September 2008, bringing together Chris Reifert, Danny Coralles and Eric Cutler for another slice of death & decay.

These tracks make up a special, extremely limited (only 1,000) 7" vinyl release, titled "Horrific Obsession". This 7" will be available exclusively from the Peaceville website on 26th January 2009, with pre-orders being taken now in the Peaceville webstore.

In addition to this, a special 2 disc edition of Autopsy's iconic debut album "Severed Survival" will be released in February to celebrate the 20th anniversary of the original release.

Everyone's favourite San Franciscan sickos - an inspiration to an entire generation of death metal bands - have unearthed rare rehearsal & live material for a bonus disc, including demo versions of two songs, "Mauled To Death" and "Human Genocide", which were intended for the original "Severed Survival". Also featured in the package is a booklet with notes by the band themselves, detailing the history of Autopsy's early years, with rare photos and images.

The Chasm - New Album Coming Soon

The Chasm will enter The Ensomberoom Studios in Fort Wayne, Indiana, early december, to start production for the still untitled 9th chapter, recording of drums and rhythm guitars will start this procedure, all the other elements of the album will be tracked at Lux Inframundis in Chicago, is expected that the recording process will be a long one, due to different factors, but all tracking will be finished by the end of january/early february, the mixing and mastering stages will take shape shortly after. Seven songs at a clocking time of aprox. 55 minutes will compose this new opus, the hymns take us once again to a long darkened path in this neverending crusade, expect the classic The Chasm style with the unavoidable twists and turns scattered all over the whole infra trip.

In related news, Lux Inframundis will be in charge of this attack, the album will be released in a limited CD version, as well as on a special limited edition vinyl, the plans are being worked out at the moment, so stay tuned for more details as they become available. Pagan's Mind - Working On First Live DVD

Norwegian metallers Pagan's Mind have posted the following tour recap about a week ago:

"We just returned from three weeks of tour craziness along with our friends from Sonata Arctica and Vanishing Point. Thanks to all those guys as well as their crews for a great time with ringing ears, lack of sleep, greasy aftershow food and stress - let's do it again soon!

Anyway, we aim for more exhaustion, and are currently hard at work putting together our first DVD. We filmed our hometown (well, almost) show in Oslo, which went beyond our expectations, and are currently editing this and taking care of the bonus material. We aim for an April release, so be prepared for a real pagan live assault."

Suicidal Angels - Bassist Leaves The Band

Suicidal Angels have issued the following update on their MySpace:

"We regretfully announce that our bass player Sotiris decided to leave the band due to personal reasons. It was a tough decision and he struggled for months before making it, but in the end he just believed it to be the best choice.

Sotiris joined the band in 2006 and was the band's bass player for many important concerts and all European tours up to now. He also was part of the line-up for the band's debut album, "Eternal Domination", and can be seen performing on stage in Suicidal Angels' upcoming DVD, "Live Domination", and various videos uploaded on YouTube. Together with the rest of the band, he tried hard to promote Suicidal Angels' music and helped make the group a better live act.

Suicidal Angels would like to thank Sotiris for his contribution in the two years he was the band's bass player. We respect his decision and wish him the best for his personal as well as professional life.

Suicidal Angels will go on as scheduled, regarding the recording of their second album in Spring 2009. More news on that will be posted very soon.

Regarding live appearances, you have probably gathered that the bass player position is now open. It is possible, however not 100% sure, that Sotiris will play the gig with Dew-Scented in February. We have already considered some candidates for the job he leaves behind and we'll have more on this in the next few days."

Armored Saint - New Album Due In 2009

US Heavy metallers Armored Saint have posted the following news bulletin on http://www.myspace.com/armoredsaint1:

"Due to the nature of vague speculation albeit created by your authors here, Armored Saint are officially announcing that they've begun writing new songs for a new record due in 2009.

The band line-up is as it was on 2000's "Revelation" and 1992's "Symbol Of Salvation". John Bush (vocals), Jeff Duncan (guitars), Phil Sandoval (guitars), Joey Vera (bass) and Gonzo Sandoval (drums).

The band has written close to 12 songs as of now and are ready to enter the recording studio in the next month or so. Some working titles include: "Loose Cannon", "Chilled", "La Raza" and "Black Feet".

The band plans on entering the studio with bassist Joey Vera handling the engineering and producing duties.

Saint will be headlining one show in Los Angeles at the Keyclub on March 6th 2009. Aside from the co-headline tour in Australia in March with Death Angel and the headlining of the Keep It True Festival in Germany in April, the band has no further shows booked at this time. There are a few festivals in Europe during summer being looked at for booking but no confirmations as of yet."

Goat The Head - Replace Bass Players

Goat The Head have posted the following on MySpace:

"We've had some changes in our primal caveman personell. Goat the Head and bassist Snorre Hovdal has decided to part ways. There's not much drama in this, we've just evolved in somewhat different directions. Goat The Head are still very grateful for everything Snorre have done for the band and will naturally wish him all the best in his future endeavours!

New man responsible for the low end frequencies in the caveman collective is mister Trond Frønes. Trond has a broad musical background and some of you may know him from bands such as Cadillac and All Trouble. We're very excited to see what the future can bring with Trond in on the troglodyte team."

In other news, the band added: "Work on our sophomore full length album is well underway. We've already recorded one preproduction of eight songs and it's not bad. Not bad at all. As a sneak peak, here are some titles for you: "Primal Caveman Death Metal", "Salt", "Uncanny Valley Clan" and "Bestial Domestication". There are even som nifty surprises in store..."

Man Must Die - Working On New Album

Relapse Records posted the following press release on November:

"Glasgow, Scotland's Man Must Die have entered the studio to begin recording the follow-up to their Relapse debut, "The Human Condition". This brand new album, "No Tolerance For Imperfection", is being recorded at Grindstone Studios in the UK with producer Scott Atkins.

Man Must Die's Danny McNab commented on the new album: "With 11 songs, full to the brim with anger, heaviness and melodic hooks, MMD cannot wait to unleash this new slab of aural assault and hit the road to promote "NTF"I. We are really psyched about the new record, its like we are a new band with a new found passion for the extreme, we cannot wait to get on the road again and show what MMD are all about. We really think fans old and new will love "No Tolerance For Imperfection" - it's pure MMD but with some new twists and turns, and definitely a new level of intensity. We have all ages shows in only Adelaide and Sydney. In these places you can be as young as 9 years old and still attend. Government laws in the other states do not allow us to have all ages shows in Perth, Melbourne and Brisbane, these shows will be 18+. See you there!"

Vreid - New Song, E-Card Posted Online

Vreid have posted a new song, called "Speak Goddamnitt", online at the band's official MySpace. The track comes off the group's fourth album, "Milorg", which is scheduled for release in Norway on January 5, 2009 via Indie Recordings (January 19 in the rest of Europe).

Arkona - Started To Record The Fifth Album

Russian Pagan/Folk Metal band Arkona have issued the following message on their MySpace:

"Arkona started to record the fifth album, named "Goi, Rode, Goi!" which will include 12 tracks with common duration more than 70 minutes. Musically, the album continues the conception of previous two albums of the band, but something new will appear in arrangements - the band invited a string orchestra and a real chore. The list of invited musicians is already known: all live parties of ethnic instruments are performed, as before, by Vladimir Cherepovskiy - the specialist in old instruments and music. Accordion is played by Alexander "Olen'" Oleinikov of Kalevala band. The band plans to widen the list of instruments never being used before. Shaman drums are already ordered from a famous master Dmitriy Ravich + line of jaw harps and some other ethnic percussion.

The special stuff of the new album is a 15 minutes long song "Na Moey Zemle" ("In my land"), a kind of pagan metal opera about the travelling of Slav around countries of Europe. Guest vocal parties are performed by Skyforger (Latvia), Obtest (Lithuania), Månegarm (Sweden), Menhir (Germany) and Heidevolk (Holland). The design of the new album is already developed and soon will be realized by well known artist Kris Verwimp.

The album will be released under Napalm Records label, not earlier than end-spring 2009. Conversations about Russian release of this album are still being held.
