Formally there was no game, so no win and no loss. Socially there is a problem precisely because the game *didn't happen* and *that* is favourable to one side but not the other.
For someone who clings to formal interpretation on the one hand, you are drawing an arbitrary conclusion on the other. One does not follow from the other.
@Ivor: Is it not? Think about it. He can shout that the case was dropped and that he is not a rapist. His accusers can say: "Well, yeah, but technically...". Regarding if someone like him or not: that's a big win.
